THE SCHEME AND CONCEALMENT - PHASE TWO

January 15, 2017:

Ralph purportedly signed a Petition seeking Heilman's appointment as co-trustee of the William H. Johnson Jr. Living Trust. The petition was prepared by Attorney Helder who knew that Ralph received personal care defined under MCL 750.145m(m), however Helder omitted that information from the petition to make it appear that Ralph was capable of performing financial transactions and that he just needed a little help. The petition was not served upon Kirk Siddell, Ralph's son who is an interested person for purposes of notice under MCL 700.1403(c)(i), MCR 5.102 and MCR 5.120 under the William H. Johnson Jr. Living Trust.

February 24, 2017:

Jeffrey Helder transmitted an email to Ralph Siddell's email account that attached a redlined draft of a proposed trust amendment. The proposed draft was deceptively redlined as follows: The $100,000 distribution to Linda Smith was eliminated without demonstrating that it was eliminated. The true distribution of the tangible personal property that was to be distributed to Linda Smith were now deceptively distributed to Stoutin, Heilman and Jerry Schmidt (a friend). The draft contained terms that adversely affected the fixed distributions to beneficiaries under Ralph's 2012 Amendment by deceptively providing an expanded the pet trust and administrative fees that would allow the trustee (Heilman) to evade distributions to any beneficiary.

March 8, 2017:

Heilman drove Ralph to Helder's office to sign the revised estate plans. Jeffrey Helder handed the documents to Heilman to explain to Ralph. At the time that Ralph signed the estate documents, they both knew that Ralph Siddell was 86 and elder under 42 USC 1397j(5), who received personal care defined under MCL 750.145m(m) that included cognitive supervision from a licensed health care provider -- Denise J. Teunis. Jeffrey Helder did not provide Ralph the estate plans he signed that day. Instead, on May 7, 2017, Denise Teunis signed the receipt for the estate plans. There is no proof that Ralph was ever given a copy of the documents he signed at Helder's office on March 8, 2017.
